BAD CHECK RESTITUTION PROGRAMME

One of the important programme is Bad Check Restitution Program in order to encourage the business people and as well as general public, because banks, public, traders etc are involved. It is conducted by District Attorney?s office.

Cheque is also mean Check.

What is bad check? The Bad Checks means cheques which were given in anticipation of cash and returned without cash. When cheques bounced, these are called BAD CHECKS. The bad checks impact negatively on local businesses and the community as a whole. Besides costs also involved for enforcement and prosecution. Hence The District Attorney?s office has instituted a ?Bad Check Restitution Program with two goals

1) To increase the accountability who pass bad checks

2) To return to victims which is their right to get the amount. .

So that merchant receive 100% of the monies owed to them.

Out of other services of District Attorney, Bad Check Restitution is most useful to the business people.

PROCESS

Under this scheme, when you unable to get the amount by the victim, the following process should be followed

A personal contact should be made with the check writer. If victim could not met, a courtesy notice in the format of BAD CHECK CRIME REPORT FORM. The check writer has to respond and to remit the payment within 10 days time. In case you did not receive or hear from the check writer for payment. The person can contact the Bad Check Restitution Program at (800) 597-2644 for a crime report. Thereafter the Bad Check Crime Report form should be send to the San Bernardino County District Attorney, Bad Check Restitution Program, 700 East Redlands Blvd. 3U, PMB 375, Redlands, CA 92373. The Bad Check Crime Report Form should be supported by the originals of all checks and notification documents i.e. Return receipts and bank notices etc.

ELIGIBILITY AND INELIGIBILITY

ELEGIBILITY

The following checks are eligible for the Bad Check Restitution programme

1. If the amount is not more than #2,500. There is no minimum. However multiple checks are not allowed.
2. The Check received in the San Bernardino County, and deposited in a bank only for exchange for goods and services and good at the time of acceptance.
3. A courtesy notice is sent to the check writer allowing 10 days to make the check good.
4. It should be submitted to the program of Bad Check Restitution within 90 days of the check.
5. A photo I.D. i.e. driver?s license, military I.D., State Identification card or a check cashing card number was recorded at the time of the transaction.

INELIGIBILITY

The following checks ineligible for the District Attorney Bad Check Restitution Program.

1. It is post dated.
2. Both parties knew there were insufficient funds at the time of transaction.
3. In case two parties, stop payment, rent, government, issued or pay roll check.
4. The identity of the check writer is unknown.
5. There is no amount, date or signature on the check.
6. It has not been processed by a bank.
7. The check involves an ?extension of credit? or payment on an account.

However they can be pursued visa small claims court or by a private collection agency.
