RAPE is NOT a LIFE THREATENING Situation, says the D.A.

WARNING: This will disturb you to say the least:

The DA's office does NOT consider rape to be a life-threatening assault. THIS MEANS they will charge anyone who uses lethal force in self-defense against a rapist with SECOND DEGREE MURDER or attempted murder.

Surprisingly, many agree with this! In a poll taken, 49% of people feel that rape is not a crime that one should loose his life over, another 25% feel that rape is awful and the victim should only use violence as a LAST RESOURT, 10% feel that lethal force is needed and the remainder is undecided!

I don’t even want to give any more of the responses to this article.

MY OPINION: If someone is going to rape me I will do whatever I can to excape the situation, even if this means murder. I refuse to abide by this ludacris law. I am absolutely shocked and horrified to discover that I could spend 12 years of my life or more in jail because some a**hole decided to attack me.
I understand that the DA needs to have some kind of limit. For example, I saw on Court TV a case where a woman murdererd her husband because he tried to rape her, supposedly.
BUT, I think this law in general is rediculous. It almost encourages rapists to rape.

If a rapist attacks a woman... she should have every right to defend herself in whatever way she can. If that means the "poor rapist w/rights" gets his eyes poked out, a certain body part cut off or even loses his life... TOO BAD!

So what, now girls have to be careful not to "harm" their rapists??? Makes me angry just thinking about it...

I have absolutely no clue what the attraction is in rape. Even though the practice exists in other animals than humans, and is explained by sober scientists with reams of data as a means of expanding the reproductive opportunities of its more successful practitioners. Infanticide (of other offspring than your own) falls in the same category.

Doesn't matter. The very thought makes me ill. And the opposite of hard. If I tried it, the girl wouldn't have to kill me. The guilt would do it for her.

Guys - if women have to take the lead on this, we pay. Especially me: I can't get a date as it is. A world dominated by paranoia isn't worth living in. Right, Mr. Bush? When will we learn?

They have a zero-tolerance policy for murder & attempted murder. Supposedly there has been 10 documented cases thus far where women have served time for attempting to "injur" their rapist.
It's awful. Something really needs to be done.

This entire thing reminds me of a story that was in the news a while back. I guess some robber tried to break into this ladies house. It was winter & He slipped and fell on her stairs that had not been shoveled properly.
The guy ended up suing and winning.
How could the government let stuff like this happen? Who are we protecting?

Neither do I. Except on TV, and videos, and movies, and books, and ... I remember many years ago starting to read a sci-fi volume in which the protagonist was a leper. He gets cured and the first thing he does is rapes a girl. I put the book down and have never touched it, or anything by this author, again. IMO, we have to be very careful, in this video-driven world, what we put out there.

1. The law is always on the side of the WOMAN. The logic is that NO WOMAN would expose herself to public scrutiny IF what she was saying is not true.
2. In the case of rape here, we have an automatic death penalty.
3. Age doesn't matter. You rape someone here they will GET you dead.Even if you are 70 and the woman is 80 you still will get the death penalty.
4. If you defend yourself against rape HERE and shoot the guy, you're a HERO! You have the perfect right to protect yourself.

... the cry of "Rape!" makes a great cover. That cry, of "Rape!" and of "lesser" sexual offenses, has destroyed not a few INNOCENT men, at least here in the US. Where plenty of people, male and female, expose themselves to public scrutiny for any number of reasons, few of which have anything to do with "the truth".

Why do I suddenly feel that I can get myself in really hot water for suggesting that, shock horror, a male accused of abuse might actually be INNOCENT? What does that say about us, and what we've become?

No it isn't. Justice, at least in the US, is supposed to be blind. But increasingly it sneaks peeks. At your gender, and color, and creed, and especially, your income. And tips the scales accordingly. :(

Self-defense, in the legal description, means that you used enough force as was necessary to keep the action from occuring or reoccuring. So, that one site you read was correct, although in a flawed sense, when it talks about a gun being used for a gun, or a knife for a knife. The flaw was that you do not need to walk down the street armed to the teeth with every kind of weapon imaginable so that you can match the attacker's weapon. Instead, if he attacks you with a knife, feel free to break his neck if he comes after you repeatedly, but it better be repeatedly or with strong force, otherwise, killing him would not be in self-defense. And to say something that won't attract any admirers, the law has to say as much. Say you have a woman who slaps a man. He decides he was injured, so he kills her. Without laws governing what is and what is not self-defense, this would be perfectly acceptable.

That being said, the legal way can kiss my big white butt. A guy attacks me, and I will do everything in my power to make sure it's one of the last things he ever tries. Because if they charge me with attempted murder, there will be at least 12 jurors who will be very sympathetic to me, and one prosecutor's office that wishes they never brought that case.

And finally, what O'Ceallaigh mentioned about women who accuse when the action never occurred is just as disturbing to me. Look at what's happening at Duke right now. I can't say for sure the woman wasn't raped, but all the evidence is making it seem pretty unlikely. I just can't understand either rape or those who falsely accuse. Both types seem like very disturbed individuals to me.

If I am correct, my understanding is that there is no "trial" per say in PA. It is open and shut case. This is why they're reexamining the laws there. There's probably numerous other states just like this but they were not mentioned and I did not feel like looking it up.
This blog made me so mad today. I was actually furious while writing it. I hope others share my anger and realize that this is so wrong in every way.

What a pretty messed up world we live in! I don't think many men understand the rape thing. I remember one of our judges saying that women don't always mean "No" when they say it. I'd love it for all rapists to be sent to jail for life - and castration. No man will ever understand the impact that rape has on a woman, or young girl.
