GROUP E

The group E - Departure.-
Ex works (named place...) : with this INCOTERM 2000 the seller (or exporter) deliver the goods at his premises or to another named place (i.e. factory, warehouse, etc) and position them for the buyer's (or importer) collection. The seller has no obligation to load the goods on any collecting vehicle neither to arrange contract of carriage.
However, if the parties wish the seller for be responsible for the loading of the goods on departure, this must be clear state in the contract of sale. The seller bear the risks and the cost of such loading. Hereafter the seller and buyer obligations

Seller' s obligations:

* The seller must provide the goods and the commercial invoice in conformity of the contract of sale.
* Provide with all the assistance to the buyer with documentation (customs, permits, inspections, etc) in order to do the export.
* He is NOT obligated for any contract of carriage and contract of insurance
* Must produce the goods to be ready for collection on the date agreed, not loaded on any vehicle.
* The seller must bear all risks until the goods has been collected by the buyer on the time and day agreed.

Buyer's obligations:

* The buyer must pay the price of the goods prior to collecting and in accordance with the contract of sale.
* The importer must be responsible to obtain all permits, official authorizations and customs formalities for the export of the goods.
* He is NOT obligated to do the contract of carriage and insurance, however for his own interest he must perform these tasks.
* He must take delivery of the goods.
* The buyer takes all the risks from the point where the goods are being collected in accordance with the contract of sale.
