Civil Lawsuits Against Gangs

Some time ago I wrote about this new thing concerning lawsuits against judges. Well, now the trend seems to be civil lawsuits against gangs.

Supposedly, the intention is, by suing gang members, people can get judgments against these folks so that they can't associate with each other, can be pulled over by the police and searched for contraband, and violations for even sitting on the porch while another gang member walks by can earn someone a year in jail.

At first glance, this seems fine by me in communities that have to deal with gangs, drive-bys, drugs, etc. At second glance, it's not so cut and dry. The issue is if these folks can't get convicted on criminal charges where being in a violent gang is already a felony, is it necessarily fair that they can be found guilty in civil court and have criminal charges filed against them on things that might be violating their civil rights?

This is a different rant than the type against civil lawsuits where someone was found not guilty in criminal court and then was sued for monetary damages (which I'm against, by the way), because instead of suing for damages, they're suing for rights to the streets where there may not have been any criminal trial to begin with.

Unfortunately, it's a slippery slope type of question that's not easily answered. It'll be interesting to see what your comments might be.

Then again I am not scared of a challenge:) I am with you on the civil rights issue here, but only because the way this country is run today, it's just another excuse to do just that. I will say though that if myself or someone I love, were hurt by any gang of thugs, I would want to go after them with EVERYTHING I had at my disposal. It is an emotional issue and a rights issue, both of which are not the best companions. When it comes to the law and emotions it should be that "never the twain shall meet" however the reality dictates that they practically sleep together:( Great post...I like posts that require the use of my limited brain cells:)

Glad to be mentally challenging. Truthfully, if it were my family member, I'd probably be wanting to go get myself a gun and start taking people out, rather than suing them.

Wow Catfish- you are making us think aren't you

I think I tend to sway your way in this issue. Criminal law is different than civil law. So yea,I think your right that it wouldn't be right to get these guys on a civil case if the criminal one doesn't get them. That would be a little backward I think. Not to mention, that gangs and their members dont care about felony criminal charges, so what makes anyone think the civil ones are going to make them wake up? Really good post though. Is this something you were reading about?

It was a newspaper story that started me thinking about it. They were talking about both Los Angeles and St. Louis as starters.
